Lawyers at the Council of State and the Court of Cassation, or Avocats aux Conseils, are specialised litigators before the two highest bodies of the French courts.
With its team of experts in the field of cassation, our firm has extensive experience in litigation and constantly has a significant portfolio of cases.
Although they mainly appear before the Council of State and the Court of Cassation, our Avocats aux Conseils also regularly represent clients before the European Supreme Courts such as the European Court of Human Rights, the Court of Justice of the European Union. They also handle cases before the ordinary administrative jurisdictions such as the Administrative Court and the Administrative Court of Appeal, the financial courts and jurisdictions such as the Court of Audit, Regional and Territorial Audit Chambers, and the Court of Financial & Budgetary Discipline. Finally, they also appear before the independent administrative authorities, including the Competition Authority, Audio-visual Council, Financial Markets Authority, etc.
Their acknowledged expertise in constitutional law and, more generally, the review of compliance with existing laws, naturally leads the Avocats aux Conseils to file and consult parties on Priority Issues of Constitutionality (Questions Prioritaires de Constitutionnalité). They do so before the two highest bodies in the French court system and, if necessary, before the Constitutional Council.
Avocats aux Conseils combine their litigation practice with an important advisory and consultancy practice, assisting parties on deciding whether to exercise an effective remedy or by analysing the law in the context of an ongoing litigation.
There are approximately 100 Avocats aux Conseils in France. They practice individually or in partnerships, within 68 firms.
